DC Federal Judge Rules DACA Must Stay, Pending 90-Day Appeal Window

Exciting news out of the Federal District Court in DC this week! Judge John D. Bates ruled that DACA protections must stay in place and that USCIS must accept initial applications, given the government’s decision to terminate the program was based on unsubstantiated allegations that it was unlawful. However, the judge gave DHS 90 days to submit a better explanation for their decision, so USCIS will not be accepting initial applications right away. If DHS fails to do so, initial applications will be accepted.
